Acceptable Use Policy

This Acceptable Use Policy ("AUP") applies to all use of OPENWAY, a cloud platform operated by OPENWAY PTY LTD. This AUP is part of the OPENWAY Terms of Service.

You must not use OPENWAY for illegal, harmful, deceptive, abusive, infringing, or high-risk activities. We may suspend or terminate accounts, deployments, workloads, or access where we reasonably believe this AUP has been violated.

1. Prohibited Activities

You must not use OPENWAY to:

  • Violate any applicable law, regulation, sanctions rule, export control rule, court order, or third-party right.
  • Host, distribute, execute, or facilitate malware, ransomware, viruses, worms, botnets, spyware, exploit kits, or other malicious code.
  • Conduct phishing, credential theft, account takeover, social engineering, impersonation, or deceptive activity.
  • Send spam, unsolicited messages, bulk messaging, or abusive communications.
  • Conduct denial-of-service attacks, stress testing without authorization, traffic flooding, or resource exhaustion attacks.
  • Scan, probe, access, attack, or interfere with systems, networks, accounts, or data without authorization.
  • Operate open proxies, VPN services, traffic relay services, anonymization services, residential proxy networks, or similar services intended to mask user identity, bypass access controls, evade platform restrictions, or facilitate abusive traffic.
  • Mine cryptocurrency or operate blockchain validation workloads unless expressly authorized in writing by OPENWAY.
  • Generate, host, or distribute illegal content, non-consensual intimate content, child sexual abuse material, terrorist content, violent extremist content, or content that incites violence.
  • Use AI models to generate deceptive deepfakes, fraudulent media, or content intended to deceive, defame, or harm others in violation of applicable law.
  • Infringe intellectual property rights, including copyright, trademark, trade secret, software license, or model license rights.
  • Process, store, or transmit regulated sensitive data unless you have obtained our prior written approval and implemented appropriate safeguards.
  • Provide financial services, investment products, lending, gambling, betting, lottery, adult entertainment, weapons-related services, or other restricted services through OPENWAY without our prior written approval.
  • Resell OPENWAY in a way that hides the identity of end users or prevents compliance, abuse prevention, or lawful requests.
  • Use OPENWAY to evade platform bans, sanctions, geographic restrictions, security controls, or law enforcement actions.

2. Security Responsibilities

You are responsible for securing your applications, credentials, API keys, secrets, environment variables, models, dependencies, and deployed workloads.

You must promptly remediate vulnerabilities, exposed secrets, abuse reports, and security issues related to your account or workloads.

3. Network and Resource Abuse

You must not use OPENWAY in a way that disrupts, degrades, overloads, or harms OPENWAY, other customers, infrastructure providers, payment providers, or third-party systems.

We may rate limit, throttle, isolate, suspend, or terminate workloads that create operational, security, cost, or abuse risk.

4. Compliance Reviews

We may review accounts, deployments, logs, metadata, usage patterns, billing activity, and support reports to detect abuse, enforce this AUP, comply with law, and protect OPENWAY.

We may request additional information about your identity, business, workloads, customers, or use case. Failure to provide requested information may result in account suspension or termination.
